GENERAL TERMS & CONDITIONS

  1. The following general terms and conditions (hereinafter referred as “T&C”) are applied to the sale and purchase agreement (hereinafter referred as “agreement”) of the products designed by Alessandro Dubini (hereinafter referred to as “AD”) through the website: alessandrodubini.com (hereinafter referred to as the “website”).
  2. The user (i.e. client) declares to be 18 years of age or older, and in full belongings of his/her rights.
  3. By accepting this Agreement the user (i.e. client) declares his/her acceptance of the T&C before placing an order. The user (i.e. client) also declares that any order carried out will not have a business/ professional/trade scope. The user (i.e. client) hereby guarantees that the personal data provided during the registration procedure for the Website are complete and truthful and undertakes to indemnify and hold harmless AD from and against any losses, damages and/or liabilities deriving from and/or connected to the violation of the regulations concerning the registration on the Website or the conservation of the related credentials. All the orders placed through the Website (i.e. alessandrodubini.com) are intended to use in the country they were ordered from. The user (i.e. client) declares his legal capacity to act according to the T&C set in this Agreement.
  4. An order can be placed/processed using any of the following methods: via internet: through the website alessandrodubni.com and/or via e-mail: at shop@alessandrodubini.com
  5. The description and photographs of products on the AD website have illustrative purposes and do not constitute a legally binding offer (the colors in particular may not exactly correspond to the real ones due to the internet browser or monitor characteristics). There is no legal claim to the availability and deliverability of the products shown on the Website. AD reserves the right once an order is received to cancel it in the case of unavailability. Whether, before the delivery of the order, the product (or products) will not be available anymore due to occurred damages or supply stock outs (of which AD is not responsible), AD will promptly inform the user (i.e. client) about the inconvenience and reimburse the equivalent amount of any payment received.
  6. The prices shown on the AD website are listed in Euro and include VAT according to the applicable Law. They can be changed at any time without notice; however, the ordered articles will be invoiced at the price listed during the recording of an order.
  7. The user (i.e. client) who wishes to conclude the agreement and purchase the product (or products) must express this willingness through a Website request clicking the place order button. After placing the order the purchase order confirmation will be sent to the client and he/she can proceed to the payment. Certain products do not have a place order button option, but an information/estimate request needs to be sent via e-mail.
  8. The client can make payment(s) through PayPal. In the case in which the customer would like to use another form of payment he/she should contact our offices by email: sales@alessandrodubini.com
  9. All orders will be delivered to the address requested, either in France or abroad. The delivery time takes into consideration the preparation and the expedition. The AD is not responsible for any delays in delivery. For deliveries abroad (outside the European Union) and to the French overseas territory, possible taxes might be charged at customs. These costs must be paid by the client. The AD cannot be considered responsible for customs taxes and it is not its duty to verify and communicate these costs to the customer. The AD reserves the right to suspend without advance notice or justification delivery to a zone, in France or abroad, for which it cannot t assure a safe and reliable service of delivery. In that case, any payments already completed would be totally refunded to the client. The transfer of the transportation risks from AD to the client applies with the delivery of the product (or products) operated by the carrier to the address indicated by the client. During the possible withdrawal period referred below, the client is responsible for the product (or products) as guardian. In case of damage or destruction of the product (or products) during the custody of the client, the client will be considered responsible. Orders will be delivered from the transportation carrier appointed by AD from Monday to Friday. The user (i.e. client) is responsible for the delivery address indicated by the client. Delivery is to the ground floor front door of the building and does not include any assembly or unpacking services. Mail boxes will not be considered eligible for delivery for certain products. The delivery note issued by the transportation carrier will constitute a proof of transport and risks transfer. AD recommends the client to carry out a check of the delivered product (or products) packaging before signing the delivery note.
  10. If the client does not receive his/her order within one week from the dispatch date: the client should verify the accuracy of the delivery address; the client should inquire at his/her own post office. If the searches above remain inconclusive, the customer is asked to get in touch with AD’s customer service. In the case of disappearance or theft of the delivery, the client is asked to inform AD as soon as possible. An inquiry will be made with the post office or with the company responsible for the shipping. Only after having excluded the responsibility of the client, the AD will then proceed to refund the order. AD recommends you do not accept the delivery if the packaging is damaged. The acceptance of a damaged package engages the responsibility of the customer.
  11. The AD remains owner of the goods up to their complete payment by the client. From the time of delivery the customer is held responsible in the case of disappearance or degradation of the goods. For every order the AD will send an invoice by e-mail to the client, mentioning all the information given by the client. The client is required to verify the accuracy of this information and to indicate any possible corrections that need to be made.
  12. The AD treats the client’s personal information according to the current regulations. Every client has a right of access and rectification concerning his/her information. It is possible that the client may receive commercial propositions via e-mail or mail if he/she does not wish to receive any of these, please contact us by providing: First and last name, address and e-mail address, at info@alessandrodubini.com
  13. The client agrees not to use programs or manual processes to copy Alessandro Dubini’s internet pages, images or information without our written authorization. In any case, the information, images, logos and other types of information contained on Alessandro Dubini’s website may not be copied, used, modified, diverted or sold for private or commercial purposes. We authorize our customers to create links towards Alessandro Dubini’s home website.
  14. The client may buy any product present on the electronic catalogue of alessandrodubini.com at the time of the order. The images and the technical information concerning a product may not be complete. In the case of obvious error between the characteristics of the product and its representation, the AD cannot be considered responsible.
  15. The AD declines any responsibility in the situation that a product does not respect the current legislation in the country of the customer (censorship, ban on a title or on an author). The customer has to verify with the local authorities the possibility of import or use of the products which he/she intends to command. The AD declines any responsibility in case of non-compliance with a contract/ agreement due to major cases of disruption (strike, flood, fire). In any case the AD cannot be considered responsible in case of loss of value or any other damages unpredictable at the time of the purchase or the consultation.
  16. By making an order on alessandrodubini.com, the client confirms to have read these general conditions of sale and to accept them. Therefore the client forfeits using any other contradictory documents. Making an order implies the acceptance of the present general conditions of sale. The present general conditions of sales are modifiable at any moment without advance notice.
